On December 19, the Pennsylvania State Supreme Court issued a ruling striking down key portions of Act 13, striking a crushing blow to the gas industry and a huge victory for community rights in Pennsylvania. ┬áMost notably the ruling was not issued based on some legal technicality, but based on the provision of the Pennsylvania State Constitution ensuring citizens’ right to clean air and water.


In the majority verdict, Chief Justice Ronald Castille writes, “By any responsible account, the exploitation of the Marcellus Shale Formation will produce a detrimental effect on the environment, on the people, their children, and the future generations, and potentially on the public purse, perhaps rivaling the environmental effects of coal extraction.”
